While it may seem that way, it&#039;s not always the case.  In the court I work in we had an egregious birthing case that left the baby dead and the mother retarded and blind.  (Lack of oxygen during the birth.)  After the plaintiff&#039;s presented proofs the parties settled for 12 million.
