If it’s the value of the lost claim, I’m all for this. A well proportioned, mildly punitive sanction. But if it trebles pain, suffering, mental anguish, loss of consortium (you’d be surprised what trouble with the insurance company can do to your libido), this new measure is a travesty.

I expect that ‘travesty’ is probably the right answer.
