Boy howdy, it’s hard to refrain from the obvious joke here: that the ACLU is concerned that the state law examiners’ actions would cut into future ACLU membership.

Yes, there may actually be a point to this one. Given the modern push to turn everything into a “mental disorder”, and the fact that the question asks about the applicant’s history from the age of 16, it’s possible a lot of perfectly sane people might be excluded. Hard to tell.

It isn’t clear to me from the article whether the ACLU is opposed to all inquiries into the mental health of prospective members of the bar or is just claiming that the existing enquiries are overly broad and would be satisfied with narrower enquiries, restricted to conditions likely to interfere with the practice of law.

I’m surprised that there aren’t more insane lawyers and think this is a shame. Surely being a lawyer is better than being a mass murderer or a circus geek.
