According to The Skeptical Enquirer (the journal of the Committee for The Scientific Investigation of Claims of The Paranormal), the answer is no.

His case “follows a landmark ruling last month that environmental views should be considered equivalent to religious and philosophical beliefs”.

However in the case of the environmental ruling they are right on the money!
