Apparently the mascot had been using an airgun earlier but then switched to hand throwing and it was one flung that way that hit the complainant.

Looking back at my comment, I could and should have been a little clearer and more polite. I was not trying to say “YOU ARE WRONG!” (which is how it could be interpreted) but rather a simple, “the hot dog that caused the injury was thrown.”

My apologies.

Most likely a coincidental event. It takes a rather severe strike to the eye to cause an retinal detatchment. (Think a paintball to the eye, fist to the eye or baseball to the eye). Also signs and symptoms of a eye injury should have been apparent immediately at the time of the injury, such as a traumatic hyphema. Risk factors for a retinal detatchment include age and being very near sighted.

To be fair to this guy, he really does seem to just be trying to cover his expenses from the detached retina and two surgeries rather than looking for a payday.

The suit asks for the medical expenses plus unspecified damages.

The hot dog was tossed, not shot out of a gun.

To me, the best line in the complaint is, “Defendant failed to train its agents, servants and employees as to the proper method of throwing hot dogs into the stands of Kauffman Stadium.”

To be fair to this guy, he really does seem to just be trying to cover his expenses from the detached retina and two surgeries rather than looking for a payday. Also the hotdogs are launched from a pneumatic gun rather than thrown if I remember right.
