An innocent defendant has been relieved of $10 million and a precedent has been set. That would seem to indicate that the legal system is based on sophistry and activism rather than law, and is a perfect example of the “constraint creep” that makes it increasingly difficult to do business in the United States.

The law is supposed to provide certainty, not uncertainty. What on Earth is “well and good” about this case?
