That seems quite unlikely. The ruling was handed down in late September during a campaign in which neither major candidate called for reforms of this sort. It is true that in the view of many, including myself, loser-pays can help to discourage the tactical use of litigation for the purpose of making life hard for people rather than winning, but experienced judges are aware of that phenomenon and would not have needed to wait for this year to take it seriously.]]></description>
