How?

This wasn’t about mileage or anything else that would be listed to the buyer at the time of sale. It’s just about a cheat to get around federal government mandated emissions standards for diesel cars.

Okay, we don’t want there to be, but since when has law been about wants? And the tobacco settlement as it was called was as big a fraud as anything VW did. Sorry, but health expenses of the states were covered in advance by all those lovely taxes they charged on the product. And just because the commerce clause covers inter-state commerce doesn’t mean it covers intra-state commerce. Anyone else want to take up the banner that federal authority starts and ends at borders?
